SENIAT (Servicio Nacional Integrado de Administracion Aduanera y Tributaria) is Venezuela's national tax authority responsible for collecting income tax, VAT, and customs duties. All Venezuelan residents must file an annual ISLR (Impuesto Sobre La Renta) income tax declaration that includes all sources of income, including cryptocurrency gains. Venezuela applies progressive income tax rates ranging from 6% to 34% based on total net taxable income. Crypto trading gains, P2P transaction profits, staking rewards, DeFi earnings, and income received in cryptocurrency must all be included in the ISLR declaration. The challenge for many Venezuelan taxpayers is accurately calculating gains given the extreme volatility of the Bolivar and the complexity of converting crypto values at the time of each transaction.
SUNACRIP (Superintendencia Nacional de Criptoactivos) was established as Venezuela's dedicated cryptocurrency regulatory authority to oversee all aspects of digital asset activity in the country, including crypto exchanges, mining operations, and crypto-related businesses. However, SUNACRIP has been effectively non-operational since March 2023. Its founding chairman, Joselit Ramirez, was arrested for allegedly spearheading a corruption ring involving over $3 billion. The agency has since been under "reorganization" with no active enforcement of its regulations. While the regulatory framework established by SUNACRIP technically remains in place, there is currently no functioning body enforcing its provisions. This has left Venezuela's crypto regulatory landscape in a state of uncertainty, though SENIAT tax obligations for crypto income continue to apply independently. Additionally, in May 2024, the Venezuelan government banned all cryptocurrency mining, ordering mining farms disconnected from the national grid and seizing over 11,000 ASIC devices.
Venezuela does not have specific crypto tax forms. Instead, all cryptocurrency income is reported as part of the general ISLR (Impuesto Sobre La Renta) annual income tax declaration filed with SENIAT. This declaration captures all sources of income, including employment, business, investment, and cryptocurrency income. Businesses dealing in crypto must also comply with IVA (Impuesto al Valor Agregado) value-added tax requirements where applicable. Maintaining detailed records of all crypto transactions, including dates, amounts, counterparties, and values in both crypto and Bolivar terms, is essential for accurate ISLR filing.
Most cryptocurrency transactions are considered taxable events in Venezuela. These include selling crypto for Bolivars or other fiat currency, trading one cryptocurrency for another, using crypto to purchase goods or services, earning crypto through staking or DeFi activities, receiving airdrops, and earning crypto as compensation or freelance income. P2P trading, which is the dominant form of crypto exchange in Venezuela through platforms like Binance P2P, is also taxable. Non-taxable events generally include buying crypto with fiat and holding it, and transferring crypto between your own wallets. Note that crypto mining was banned in May 2024, so it is no longer a relevant taxable activity going forward, though historical mining income must still be reported. Given the widespread use of crypto for daily transactions in Venezuela, accurate tracking of all taxable events is particularly important.
Venezuela's unique economic conditions have made it one of the global leaders in peer-to-peer cryptocurrency trading. Binance P2P is widely used for converting crypto to Bolivars and vice versa, as well as for receiving remittances from abroad. Many Venezuelans receive payments from family members or employers in other countries via cryptocurrency, then convert to local currency through P2P platforms. This high volume of P2P activity creates significant tax reporting obligations, as each conversion is a taxable event. Remittances received in crypto must also be properly reported on the ISLR declaration.
